What, Who and How Do Lawyers Work?

A lawyer, or often called an advocate, or attorney or legal advisor, is someone who does or provides advice (advice) and defense “represents” for other people who are related (clients) with the settlement of a legal case.

The definition of a lawyer is an attorney or legal expert, namely someone who is authorized by law by another person (client) to do whatever is authorized by power of attorney, and can also represent clients in litigation both in court and outside the court.
Advocates are people whose profession is to provide legal services, both inside and outside the court who meet the requirements based on the provisions of the law.

Lawyer Status and Ethics

A lawyer or Advocate has the status of a law enforcer, free and independent guaranteed by laws and regulations, with a working area covering the entire territory of the country he lives in. This means that an advocate can practice anywhere in the region, and may proceed in court in the territory of the country.

Advocates in carrying out their profession defending cases adhere to the professional code of ethics and laws and regulations, and advocates are obliged to obey and comply with the professional code of ethics of advocates and the provisions concerning the Honorary Council of Advocate Organizations.

The most basic relationship in an advocate-client relationship is reciprocal trust. In this relationship, the client believes that the advocate handles and protects the interests of his (clients) professionally and with full expertise, provides correct advice, and will not do things that will harm his interests.

Rights and Obligations of Lawyers

Every Advocate is free to issue opinions or statements in defense of a case which is his responsibility in court proceedings while adhering to the professional code of ethics and laws and regulations. Advocates are also free in carrying out their professional duties to defend cases for which they are responsible by adhering to the professional code of ethics and laws and regulations.

Advocates cannot be prosecuted either civil or criminal in carrying out their professional duties in good faith for the benefit of the client’s defense in court proceedings. In carrying out their profession, Advocates have the right to obtain information, data and other documents, both from government agencies and other parties related to these interests which are needed for the defense of the interests of their clients in accordance with laws and regulations.

Lawyers or Advocates in carrying out their professional duties are prohibited from differentiating treatment of clients based on gender, religion, politics, descent, race or social and cultural background. And an advocate cannot be identified with his client in defending the client’s case by the authorities and / or the community.

Every Advocate is obliged to keep everything that is known or obtained from his client because of his professional relationship, unless otherwise stipulated by law. And an advocate has the right to the confidentiality of his relationship with the client, including protection of his files and documents against confiscation or inspection and protection against wiretapping of advocates’ electronic communications.

Lawyer Honorarium

Attorneys may receive a large amount of honorarium because there are no restrictive rules. Every lawyer or advocate who works with his client is entitled to receive an honorarium for legal services that have been provided to his client. The amount of Honorarium for Legal Services is determined fairly based on the agreement of both parties, advocates and clients. Apart from receiving honoraria, lawyers are also obliged to provide free legal assistance to less fortunate justice seekers.

Lawyer Prohibited

Holding other positions that are contrary to the interests of his duties and professional dignity; holding another position that requests dedication in such a way as to harm the Advocate profession or reduce freedom and independence in carrying out his professional duties; and for advocates who become state officials, do not carry out the duties of an Advocate profession during their tenure.
